Wales Consultation on Public Procurement Secondary Legislation: Part 1

The first of two six-week public consultations on the Secondary Legislation in relation to the Procurement Bill (the “Bill”) has been launched.

Please see the attached letter which we are sending to you on behalf of the Minister for Finance and Local Government.

This technical consultation is an important opportunity for businesses and stakeholders to comment on the detail of the secondary legislation. It is not the purpose of this consultation to re-examine the policy intent behind the Bill, rather the consultation questions seek to determine whether the technical detail of the drafting is correct and / or achievable.

The Welsh Government and the UK Government have worked closely on the development of our respective statutory instruments to ensure there is maximum alignment between the legislation and to minimise any risk of potential divergence. For the purpose of this consultation, the draft statutory instrument that has been developed by the UK Government will be used. The consultation supporting document will clearly explain where clauses in the UK Government statutory instrument will not apply. However, the Welsh Government’s draft statutory instrument will mirror (as much as possible) the provisions contained within the UK Government’s statutory instrument, other than in the few areas where there are derogations or Wales-specific differences.
